PENALTIES FOR VIOLATION UNDER MARYLAND TRANSPORTATION ARTICLE SECTION 21-902 (a)—DRIVING UNDER THE INFLUENCE:

1. For the first offense shall be subject to a fine of not more than $1,000 and imprisonment for not more that 1 year.

2. For a second offense shall be subject to a fine of not more than $2,000 and imprisonment for not more that 2 years.

3. For a third offense (with two prior convictions) shall be subject to a fine of not more than $5,000 and imprisonment for not more that 5 years.

4. For a fourth or more offense (with at least three prior convictions) shall be subject to a fine of not more than $10,000 and imprisonment for not more that 10 years.

***In addition, if you are convicted of Driving Under the Influence then you will be assessed 12 points on your driving record and you will be facing a possible revocation of your license.

PENALTIES FOR VIOLATION UNDER MARYLAND TRANSPORTATION ARTICLE SECTION 21-902 (b)— DRIVING WHILE IMPAIRED:

1. For the first offense shall be subject to a fine of not more than $500 and imprisonment for not more that 60 days.

2. For a second offense shall be subject to a fine of not more than $500 and imprisonment for not more than one year.

3. For a third offense (with two prior convictions) shall be subject to a fine of not more than $5,000 and imprisonment for not more that 5 years.

4. For a fourth or more offense (with at least three prior convictions) shall be subject to a fine of not more than $10,000 and imprisonment for not more that 10 years.

***In addition, if you are convicted of Driving While Impaired then you will be assessed 8 points on your driving record and you will be facing a possible suspension of your license.
